These General Conditions of Use and Contractualization apply to users of siteje-ecomaterials and to all operations and transactions, of a commercial or other nature, carried out through this site. Jupiter Evolution reserves the right to modify these General Conditions without notice, the user being subject to the conditions in force at the time of consultation or use of the site.
Intellectual property

The site, as well as all of its content, is protected by intellectual property law, in particular by copyright and industrial property. Any use, reproduction or total or partial mention of its contents is totally prohibited, constituting an offense when carried out without the prior authorization of Portugal je-ecomaterials. In the event of non-compliance with these General Conditions or improper use of the site, Jupiter Evolution reserves the right to block or cancel the user's registration.

The data, prices and specifications of this site are presented for information only, reserving the right to modify at any time and without notice the information and commercial offers presented on: products, prices and promotional actions, commercial conditions and services . The published prices are valid for purchases made on this site, and whose delivery takes place in mainland Portugal or in the autonomous regions of Madeira and the Azores, except for computer or typographical error. The price of each product may vary from store to store. To know the exact price of a store, the user can select it through the "My store" menu, which is located on the top bar of the site. In case of price variations, the indicated value is only valid for the selected store. The price displayed by the user at the time of the online purchase will be the price charged at the time of payment.

Online orders

The finalization and the payment of the order imply the validation by the user of the data presented. Any online order is subject to the availability and quality of the items or services. In the event of unavailability, out of stock or unforeseen supply, je-ecomaterials reserves the right to inform the user of the existence of alternative products or services, of equal or superior quality and value, after which the due adjustment will be made in the final value of the order in case of modification. At the user's request, the order can also be canceled in whole or in part, with the right to reimbursement by the same payment method of the respective amount paid. If it is not possible to contact the user, the order will be canceled by je-ecomaterials, with full refund of the sums paid by the user. After validation of the payment, you will receive an automatic email confirming the order, accompanied by the details of the order. If payment is not made at the time of online purchase (eg payment with Multibanco reference), you will receive an additional email with order details and payment instructions. Non-payment of the order within the maximum period stipulated in this e-mail implies its automatic cancellation. After validation of the payment, je-ecomaterials will proceed with the preparation and delivery of the goods.

In the absence of payment of the order at the time of placing the order, Je-ecomaterials does not guarantee the availability of stock or the delivery date chosen by the user, and may be subject to modifications. The final delivery date will be communicated to the user by e-mail and/or SMS. If the user identifies an abnormal situation, he must contact the online purchase and sale contract form under the applicable legal conditions.
Order refusal

Jupiter Evolution will not be liable to the user or any third party for the withdrawal of any product or service published on je-ecomaterials, or the modification or deletion of any information concerning them. Exceptional circumstances that may lead to the refusal to process an online order, even after the order confirmation has been sent, Je-ecomaterials reserves the right to refuse an order for several reasons, namely:

When the product or service is no longer available;
In the event of an incorrect price for an item or service;
When the delivery or billing data is incomplete or incorrect;
In case of impossibility of delivery to the address indicated;
In the event of suspicion of a false or fraudulent order;
When the order has not been paid within a maximum period of 2 days after its creation;
In case of suspicion that the user does not respect the policy of conduct of the site.

je-ecomaterials reserves the right to inform the user of the refusal of the order in question and to offer or request alternative resolution solutions. In the impossibility of a consensual solution or contact with the user, the order will be canceled by e-ecomaterials, with full refund of the amount paid by the user, to be returned by the same means of payment.
Delivery of the order

Online order deliveries can be made in two ways: in-store pick-up (Click & Drive) and home delivery.
Delivery

je-ecomaterials provides for the delivery of products ordered online, properly packaged, to the address and on the date indicated by the user for this purpose. The date indicated may change, in particular due to unavailability of stock or a fortuitous event on the part of the carrier, although je-ecomaterials cannot be held responsible in the event of delivery not made within this period.

The date selected by the user is only valid from the time of payment when placing the order online. Any delay in payment may involve changes to your treatment.

Regarding the delivery of parcels in the Islands, the user has the choice between two options:

• Provide the address of a freight forwarder you have chosen, located in mainland Portugal, and the cost of delivering the order to the freight forwarder will be that of shipping to an address in mainland Portugal (the user is fully responsible for the costs inherent in the service of the freight forwarder).

je-ecomaterials informs you that the average delivery times are as follows (subject to stock availability).

• Mainland Portugal: between 2 and 4 working days for the normal transport service throughout the territory or from 3 hours within a radius of 50 km from a store for express services (if available);
Islands: from 16 working days for the maritime transport service (no weight limit) or 9 working days for the air transport service (maximum 30kg), with a maximum period of 30 working days for delivery, except conditions external to i-ecomaterials or carriers, such as weather conditions, strikes, etc.

Depending on the delivery service, the user will be notified by SMS or email by the transport company the day before the delivery date or the same day, being able to reschedule a new delivery if necessary. je-ecomaterials does not deliver on Sundays or public holidays.

If, for any reason, je-ecomaterials is unable to deliver on the scheduled date, the user must be informed and given the option of choosing a new date or canceling it, subject to reimbursement of the full amount paid.

If je-ecomaterials is unable to deliver for a reason attributable to the user, namely due to the absence of the user in the case of home delivery, or because he is unreachable to receive the order, the respective cost will be charged for the repeat delivery, in case of postponement at the request of the user.

Regarding delivery costs, they are variable, calculated according to the type of products ordered and the distance between the destination address and the warehouse. je-ecomaterials offers an estimate, assembly or installation service, which will be carried out by an installer recommended by je-ecomaterials.

When purchasing products on the je-ecomaterials site, the user has the option of requesting the installation service online (if available). In the articles where this service is applicable, there are two possible modalities:
Payment Options

Debit or credit card: The user will be redirected to the Redunicre payment portal and must enter all the requested data. In case of refusal of payment by the platform, the order will be automatically cancelled. All transactions and respective data security are the sole responsibility of Redunicre;
ATM reference: The user has the maximum time indicated in the order confirmation email or SMS to make the payment at an ATM or at home, using the data provided (entity/reference/value). In the absence of payment within the maximum period indicated, the order will be automatically cancelled;
Paypal: by selecting this payment method, the user will be redirected to the PayPal payment portal, where he will have to create an account or log in with an existing account;
3x 4x…..: When choosing the 3x 4x solution, the user is redirected to a secure page at Oney Bank where he will enter the data required to issue a credit note for payment of the order. In case of abandonment of the process by the user or refusal of credit by the identified entity, the order is automatically canceled. It is specified that no method of payment is possible upon delivery of the goods ordered, and that whatever the method of payment chosen by the user, orders placed online will only be processed by je-ecomaterials after validation of the respective payment.
Cancel or return online orders

The user may at any time cancel his online order placed with je-ecomaterials until delivery, with the right to reimbursement of all sums paid.

Upon receipt of the order, under the terms of Article 10 of Legislative Decree no., costs are invoiced.

The communication of the free termination of the contract must be made by the user to je-ecomaterials. via the contact form, or by any other unequivocal form of the free resolution form template now available.

As part of the customer satisfaction policy of je-ecomaterials, the exercise of the right of free resolution must take place within the following time limits:

Non-loyal customers (without Casa Card): the user has 100 days from the date of purchase or, if the purchase involves several items, from the day on which the user, or a third party indicated by him (excluding the carrier), acquires physical possession of the last good;
Loyal customers (with Casa Card): the user has 2 years from the date of purchase or, if the purchase involves several items, from the day on which the user, or a third party indicated by him ( except the carrier), acquires physical possession of the latter good.

In view of the resolution identified above, je-ecomaterials will reimburse the user for all payments received. The reimbursement of the sums paid by the user will take place within 14 days of the date on which je-ecomaterials was informed of the contractual termination and will be made by the same means of payment used during the initial transaction. As long as the goods are not received, or the user does not provide proof of their return, je-ecomaterials may withhold reimbursement of the sums spent by the user. Refunds will only be made after verification of the condition of the goods.

The costs inherent in the return of goods, for which the user has resolved the purchase and sale contract by exercising the right of free resolution, are the responsibility of je-ecomaterials, unless the delivery method chosen by the user is more expensive than the .by je-ecomaterials proposal.

The user must keep the goods in order to be able to return them to je-ecomaterials in the correct conditions of use, with all their components, accessories and original packaging, while being able however, and with the necessary precautions, to inspect and handle the GOOD. jje-ecomaterials reserves the right not to accept the return of items showing signs of misuse or having been altered from their original condition.

The user does not have the right to withdraw from the contract in the case of personalized and/or made-to-measure products, or which by their nature compromise the good safety and hygiene conditions of the product in question.
Warranties

In accordance with the legislation in force, all goods purchased from je-ecomaterials benefit from a 3-year legal guarantee, which may be longer when the producer or distributor of the article guarantees it. The number of warranty years can be specified on the product detail page. However, if the information is missing, it should be assumed that it has a 3 year warranty. Excluded from these cases are purchases made for professional use/corporate purchases, for which the warranty period is 6 months. In the event that, during the warranty period, the item purchased presents any non-compliance or damage, the user must contact our customer service department who will inform them of the procedure. je-ecomaterials will bear the costs inherent in the return or recovery of the non-compliant or damaged item(s), within the respective legal guarantee period. If, during the technical verification by je-ecomaterials, it is found that the non-conformity or the reported malfunction is due to improper use on the part of the user, the latter will be contacted to establish the estimate for the repair in question. With regard to the good(s) outside the legal warranty period, the user can deliver them, accompanied by the respective purchase invoice, so that the after-sales service can evaluate them, issue a technical opinion and a repair budget. After the user's agreement, the good will be repaired.

Applicable legislation

These General Conditions of Use are subject to the Portuguese legislation then in force. Any conflict or divergence of interpretation will be submitted to the Portuguese court with territorial jurisdiction. If the user is outside Portugal, i-ecomaterials Portugal informs that any legal proceedings must be submitted to the Portuguese courts.
Alternate Dispute Resolution

In accordance with article 18 of law no.144/2015 of September 8, i-ecomaterials Portugal informs that in the event of a dispute, the consumer has the possibility of proposing alternative dispute resolution entities.
